Terms and Conditions 

By booking with Jessica & George Photography, you’ll be confirming that you agree to these terms and conditions, so please read them carefully.

 

Once read and understood please complete the form below.

 

Booking a photoshoot means that you the Client, and I, the Photographer (Louise Thomas) agree to the following terms and conditions regarding the confirmed photoshoot.

This binding contract represents the entire understanding of the requirements, schedule and payment terms of a photography session.

 

1. Payments

 

A deposit is required to secure your photoshoot. A deposit is taken upon booking. Your deposit is taken off the total amount owing for the session. The remaining balance is due on the day of the session.

If further digital images, prints or wall art are ordered upon viewing the completed gallery, full payment is required at the time of ordering. Goods will not be provided until payment is received.

Payments can be made via bank transfer, PayPal or cash.

2. Cancellation by the Client

 

Should you need to cancel your session, please provide as much notice as possible. If you cancel 14 days before the session, you will retain 100% of your deposit. Should you cancel 13 days or less before your session, you will lose your deposit. Should we need to re-arrange, another date must be rearranged within 6 months of the booking to retain the deposit. After 6 months, the client understands that they will lose their deposit.

 

Should you need to cancel for any reason, please contact me as soon as possible on 07834 808427. No shows are unacceptable and result in the loss of time and earning for me and will unfortunately affect any future bookings.

3. Cancellation by the Photographer

 

If the Photographer needs to cancel a session, the photographer will contact the Client at the earliest opportunity via telephone and email to notify the client of the cancellation. The Photographer will endeavour to reschedule the session as soon as practicable.

 

For outdoor location photoshoots, the Photographer will assess the weather conditions the day before, and on the day of the session. It is the photographers decision whether to cancel the session based upon the weather conditions as rain and winds can have an adverse affect on the quality of the images captured. If this arises, the Photographer will contact the client at the earliest opportunity via telephone and email. If the Photographer cancels an outdoor photoshoot, the Photographer will endeavour to rearrange the session as soon as practicable.

4. Returns

 

All photographs shall be previewed and downloaded by the Client via an online gallery. Because this is a digital file and not a physical product, unfortunately no returns can be made, as you can see what you are purchasing.

 

Incorrectly supplied physical items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error.

 

All orders are presumed to have been received in good condition unless the Client notifies Jessica & George Photography in writing of any discrepancy or error within 24 hours of receipt.

 

All portraits, books, albums, frames, etc. are non-refundable. Orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, the Client does not have the right to a cooling off period. By placing an order with Jessica & George Photography you are committing to buy the ordered products.

 

5. Liability & Parental Supervision

 

The Clients remain responsible for any children or adults which attend the session with them.
The client shall maintain control of their children, exercise their parental responsibility whilst taking part in the session and will maintain parental supervision throughout. No other children who are not being photographed are to accompany the clients to the session.The Photographer shall not be held responsible for any and all injury to the client(s) during the course of the photography session and the immediately surrounding events.

The Photographer uses expensive equipment during the sessions. Should the Client or any guest who accompany the client to the session break or damage any property, the Client is responsible for reimbursing the cost of replacement or repair of any equipment damaged.

6. Artistic Input

 

The photographer retains the right  of discretion in selecting the photographic materials released to the Client. Photographer shall be entitled to use its judgement regarding the style and artistic input in the production and editing of the pictures. This includes but is not limited to poses, props and number of images taken. Due the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, the Photographer may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

Images are fully edited before presenting to Client. Additional edits are carried out at the discretion of the Photographer, and the Photographer reserves the right to charge the Client for additional editing to cover time involved.

 

7. Responsibilities

 

The photographer will be the sole and exclusive photographer for the listed session. The photographer is responsible for bringing any equipment necessary to conduct the services outlined. It is the Clients responsibility to arrive on time for the session. If the client is late, this time will be taken off the total time of the session. In the event of a late arrival, please contact the Photographer on 07834 808427.

8. Coverage

 

The Photographer will provide the  goods and services listed in the booking and information forms, including session coverage for the listed hours. Additional coverage hours are requested on the day of the session, the Client agrees to pay the Photographer in full for those additional hours, at the hourly rate.

The Photographer agrees to make every effort to provide satisfactory coverage, but can not make any guarantee as to specific photos or poses during the session.

 

9. Photographic Materials

 

After six months from your session Jessica & George photography will no longer be responsible for storing your image files. Jessica & George Photography highly recommends prints and products to be ordered through them, using a professional printing laboratory. If the client decides to print their images elsewhere, Jessica & George Photography is not responsible for the end quality or cropping of any of these products.

10. Model Release

 

This photography contract serves as  a model release. This grants the Photographer the right to use all images and footage without restriction for advertising, portfolios, marketing materials, sample products, editorial submissions and other lawful purposes (more specifics, see section 13.). The Client waives the right to inspect any images produced.

 

11. Copyright

 

All photographs are and shall remain the sole intellectual property of the Photographer. The clients hereby waive any rights to intellectual property, ownership and reproduction of the images produced by the Photographer, with exception of the  terms of any formal written releases provided by the Client by the photographer.

The Client has printing rights on any digital image purchased and can upload the images on to social media. Please do not amend, crop or change any aspect of your images.

12. Conduct during sessions

​

Clients are not permitted to use their own phones or cameras to take photographs during the sessions.

​

13. Vouchers

 

Vouchers are non refundable or exchangeable. Vouchers are not for resale or any kind of reproduction. Session to be booked in advance upon receiving voucher and dependent upon the availability of photographer.  Voucher is only valid once paid for in full amount by the party who has purchased the voucher. Upon purchasing a voucher, the redeemer is bound to our usual terms and conditions of photography shoots. Jessica & George Photography reserves rights to edit terms and conditions of the voucher at any given time.

14. Mini Sessions

​

Mini sessions are a maximum of 30 minutes long. If the client is late, this time can not be made up at the end of the session, and the client will lose this time from their session. Sessions are allocated on a first come first served basis. Sessions are not secured or confirmed until the deposit has been paid. There are no refunds for deposits for mini sessions. Photographs included within the clients gallery are chosen by the photographer. Photographic prints or products ordered as part of the mini sessions are to be collected from the studio free of charge, or the client can pay for postage. 

 

15. Approval

 

By booking with Jessica & George Photography the Client agrees to the terms listed below and above;

•   The Client gives permission for the photographs to be used by Jessica & George Photography for display purposes.

•   The Client gives permission for the photographs to be used within other printed publications.

•   The Client gives permission for the photographs to be used on Jessica & George Photography’s website.

•   The Client gives permission for the photographs to be used on Jessica & George’s Photography social media pages.

(If you do not wish for photographs to be used on social media please state this upon booking).

 

The Client understands that all photographs are and remain the sole intellectual property of Jessica & George Photography.
